Recent Examples of Foodborne Illness Outbreaks

Several popular and large-scale companies have been tied to dangerous contaminated food outbreaks, including:

  • Boar’s Head: The deli meat and cheese producer launched a recall for over 71 deli meats potentially contaminated with listeria. Over 7 million pounds of ready-to-eat meat and poultry products have been recalled to date. So far, 19 states have reported confirmed listeriosis cases, with several deaths and hospitalizations.
  • McDonald’s: The fast-food chain’s Quarter Pounder burgers have been linked to a massive E. coli outbreak in 10 states, leading to 90+ people getting sick.
  • BrucePac: The prepackaged food manufacturer recalled 11.7 million pounds of ready-to-eat meat and poultry products over listeria concerns. Many of these products were carried in popular retailers, like Trader Joe’s and Costco.

About the Bacteria Lurking in Well-Known Foodbrands

Listeria and E. coli are serious bacteria that can cause severe foodborne illnesses, often thriving in improperly handled or contaminated food.

Listeria is a type of bacteria that can cause a serious infection called listeriosis. It’s often found in contaminated food, like deli meats, soft cheeses, unpasteurized milk, and some ready-to-eat meals.

The U.S. Department of Agriculture uncovered shocking and unsanitary conditions at Boar’s Head’s Virginia facility, revealing the presence of mold, mildew, and insects. Disturbingly, the agency documented a staggering 69 violations of federal safety standards, including the presence of listeria.

What makes listeria even more insidious is that it does not cause the contaminated food to smell or change its texture or taste. So, unlike spoiled food, people may have no idea they are eating something that can cause a serious infection.

E. coli, on the other hand, is commonly linked to undercooked beef, contaminated vegetables, and unpasteurized juices.

Injuries in a Foodborne Illness Recall Lawsuit

E. coli and listeriosis are especially dangerous because they can take a long time to show symptoms, making it hard to know you’re infected. Symptoms can take time to appear, often ranging from a few days to as long as 10 weeks after exposure to the bacteria.

According to the CDC, symptoms of an E. coli infection typically begin about 3 to 4 days after consuming contaminated food, while listeriosis symptoms usually start around 2 weeks after exposure.

However, it’s important to note that symptoms can take even longer to develop, meaning a person could feel perfectly fine for weeks before showing any signs of illness.

Listeriosis symptoms may include:

  • Fever
  • Muscle Aches
  • Headache
  • Stiff Neck
  • Confusion
  • Convulsions
  • Loss of Balance
  • Upset Stomach
  • Nausea
  • Diarrhea
  • Chills

People suffering from E. coli may experience:

  • Diarrhea
  • Low Fever
  • Nausea
  • Vomiting
  • Fatigue
  • Stomach Pains and Cramps
  • Loss of Appetite

How Much Can I Recover in a Foodborne Illness Lawsuit?

Filing a lawsuit for foodborne illnesses like listeriosis and E. coli is a powerful way to shed light on unsafe practices and push for real change from the companies and manufacturers that jeopardized your health.

By taking this step, you can not only get compensation to address your health issues but also ensure that the food we all consume meets the highest standards and transforms the industry for the better.

A lawyer with experience in foodborne illnesses can help you obtain:

  • Past and Future Medical Expenses: Compensation for all the medical costs you’ve already paid because of the illness, like hospital bills and doctor visits, as well as any future medical expenses you might have for ongoing treatment or recovery.
  • Lost Wages: Financial support for the money you lost while being unable to work due to the illness. This includes wages from the time you were sick and any future earnings you might miss if your recovery takes longer than expected.
  • Punitive Damages: This is extra compensation to punish companies. When a company’s negligence leads to illnesses, punitive damages aim to hold them accountable and encourage them to make serious improvements. This could mean better safety practices, stricter inspections, and training for employees, all to prevent others from getting sick in the future.
  • Wrongful Death: This type of claim seeks compensation for the loss of a loved one and can cover things like funeral costs, lost income that the deceased would have provided, and emotional suffering experienced by the family.

At Levin Simes, we have a long history of standing up to large corporations that have harmed innocent people, winning billions for our clients. Companies have a responsibility to take extreme caution and implement strong safety measures before putting their products on the market.

Companies must take full responsibility for the conditions that allow listeria or E. coli to thrive in their products. There is no excuse for allowing unsanitary environments in facilities that serve food to the public. These cases aren’t just about mild stomach pains and nausea—listeriosis and E. coli can lead to tragic cases of severe illness and even death.
